HighSlack Terms of Use (EULA)

1. Agreement

By creating an account or using HighSlack ("the Service"), you agree to these Terms of Use ("Terms"). These Terms also serve as the HighSlack end-user license agreement (EULA). The Service is operated by Glenberts LLC ("we," "us," "our"). If you do not agree, do not use the Service.

2. Description of Service

HighSlack is a commercial fishing operations platform that helps fishermen track deliveries, crew, expenses, fishing periods, weather, and season financials. The Service is provided "as is" and is not a substitute for professional accounting, legal, or tax advice.

3. Accounts

You must provide accurate information when creating an account. You are responsible for maintaining the security of your password and account. You must be at least 18 years old to use the Service.

4. Your Data

Ownership. You retain ownership of all data you enter into HighSlack, including delivery records, financial information, crew details, and uploaded documents.

License to Us. By using the Service, you grant us a limited, non-exclusive license to store, process, and display your data solely for the purpose of providing and improving the Service. This includes:

  • Storing and backing up your data on our servers
  • Processing your data to generate reports, predictions, and analytics within your account
  • Using anonymized and aggregated data across accounts to improve predictions, benchmark performance, and develop new features (for example: average catch rates by district, seasonal timing patterns, and fleet-wide trends)

What we will NOT do:

  • Sell your individual data to third parties
  • Share your identifiable data with other users without your consent
  • Use your data to compete against your fishing operation

Aggregated Analytics. We may analyze data across all accounts in anonymized, aggregated form to produce industry insights, improve prediction accuracy, and build features that benefit all users. No individual user's data will be identifiable in any aggregated analysis or published insight. Examples include district-level catch trends, average pricing data, and seasonal timing benchmarks.

Data Export. You may export your data at any time through the CSV export features available in the Service. If you cancel your account, you will have 30 days to export your data before it is deleted.

5. Crew Member Data

If you collect crew information through HighSlack's onboarding feature (including names, addresses, Social Security Numbers, and signatures), you are the data controller for that information. You are responsible for:

  • Obtaining consent from crew members before collecting their data
  • Using crew data only for lawful purposes (tax filing, employment records, compliance)
  • Safeguarding any exported 1099 forms or documents containing SSNs

We encrypt SSNs at rest and limit access, but you remain responsible for how you use crew data outside the Service.

6. Subscriptions and Payment

Paid features require a subscription. Prices are listed on the pricing page and, in the iOS app, on the in-app Subscription screen. Subscriptions auto-renew unless cancelled. Web subscriptions are managed through HighSlack billing and Stripe. iOS subscriptions purchased through In-App Purchase are managed through your App Store account.

Refunds. We offer a 14-day free trial for eligible web signups. iOS subscriptions and any App Store-managed trial or introductory offers follow Apple's billing and refund policies. Payments are otherwise non-refundable except where required by law. If you believe you were charged in error, contact us.

Price Changes. We may change pricing with 30 days' notice. Existing subscriptions will not change until their next renewal date.

7. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to access another user's account or data
  • Reverse engineer, scrape, or attempt to extract the source code of the Service
  • Use automated tools to access the Service beyond the provided API
  • Introduce malicious code or interfere with the Service's operation
8. Fishing Data Disclaimer

HighSlack provides predictions, weather data, tide information, and emergency order tracking as informational tools only. We do not guarantee the accuracy of:

  • Catch predictions or season forecasts
  • Weather or tide data (sourced from NOAA and Open-Meteo)
  • ADF&G emergency order parsing or fishing period schedules

Always verify fishing regulations, opener schedules, and safety conditions through official ADF&G channels and NOAA before making operational decisions.

9. Limitation of Liability

To the maximum extent permitted by law, HighSlack and Glenberts LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, catch, or business opportunities, arising from your use of the Service.

Our total liability for any claim related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Glenberts LLC from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your collection and use of crew member data.

11. Termination

We may suspend or terminate your account if you violate these Terms. You may delete your account at any time. Upon termination, your data will be retained for 30 days to allow export, then permanently deleted.

12. Privacy

We collect and process data as described in our Privacy Policy. By using the Service, you consent to the collection and use of your information as described therein.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or in-app notification at least 14 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance.

14. Governing Law

These Terms are governed by the laws of the State of Alaska. Any disputes shall be resolved in the courts of Anchorage, Alaska.
